Ministry Clarifies Vietnam’s Generative-AI Sandbox Does Not Grant Deployment Rights

Vietnam’s Ministry of Science and Technology has clarified that participation in the generative-AI legal sandbox does not equal a licence to deploy products commercially, Vietnam News reported, citing MOST official Trần Anh Tú on the scope of Decree 142/2026/NĐ-CP. Domestic AI systems may undergo controlled testing under sandbox certificates, but those papers stop at the lab and pilot boundary until fuller authorisations under the Law on AI, effective March 1, are obtained.

The distinction matters because startups and state labs have treated sandbox acceptance as a marketing badge. Tú’s message is that regulators want experimentation without creating a back door into hospitals, banks or public services. Testers still face data, safety and reporting duties inside the sandbox; exiting into production will require separate conformity steps once the AI law’s implementing rules bite.

Decree 142 sits in a stack of industrial and talent measures meant to grow Vietnamese AI capacity while keeping high-risk uses on a leash. Officials argue the sandbox accelerates learning for local models; critics worry opaque criteria could favour connected firms. Either way, the March 1 law is the brighter line for market access.

What it means in practice

Founders should budget for a two-step path—sandbox then deployment authorisation—rather than assuming a certificate unlocks sales. Talent and incentive policies such as Decree 386’s incentives to attract data innovation experts from December and networks like NAFOSTED’s global Vietnamese AI expert network feed the pipeline, while Hanoi’s Agent City initiative for AI agents in public services shows where deployment pressure will be highest—and where sandbox limits will be tested.

Public buyers should demand proof of post-sandbox authorisation before writing AI into service contracts. Investors should treat sandbox logos as R&D milestones, not revenue milestones.

What to watch: MOST’s published list of sandbox cohorts, the first refusals for commercial launch after testing, and how March 1 implementing circulars define high-risk generative systems.
